1. Booth Rental
1.1 Premises: The Landlord agrees to rent a booth space to the Tenant at Inkestry Custom Tattoos, located at 922 Larkspur Dr. Livermore, Ca 94551, for the purpose of operating a tattoo business.
1.2 Rent: The Tenant agrees to pay a rent of $700.00 per week for the booth, subject to a 3% annual increase.
1.3 Payment Terms: The rent is due on a weekly basis. Payments are due by the end of the day each Saturday. A grace period of three (3) days will be provided, after which a late fee of $50.00 will be applied. If payment is not received within fourteen (14) days after the due date, the Landlord reserves the right to terminate the Agreement.
2. Keys and Security Codes
2.1 Keys and Codes: The Tenant will be provided with keys and security codes to access the premises. In the event that keys or security codes are lost or compromised, the Tenant agrees to pay $250.00 for the replacement of locks and recoding of security alarms.
3. Discounts on Merchandise
3.1 The Tenant is entitled to a 10% discount on the following merchandise: t-shirts, hats, hoodies, and stickers available at Inkestry Custom Tattoos.
4. Event Inclusion
4.1 The Tenant is granted inclusion in the following events hosted by Inkestry Custom Tattoos: convention guest appearances, annual Inkestry gatherings, shop anniversaries, art shows, concerts, chat boards, group messages and other similar events.
5. Non-Disclosure Agreement
5.1 The Tenant agrees to maintain confidentiality regarding all aspects of the business, including but not limited to client information, business strategies, proprietary information, and any other confidential materials related to the operation of Inkestry Custom Tattoos.
6. Non-Compete Clause
6.1 The Tenant agrees not to operate or participate in any other tattoo business within a 50-mile radius of Inkestry Custom Tattoos during the term of this Agreement and for one (1) year after the termination of this Agreement.
7. Termination Clause
7.1 The Landlord reserves the right to terminate this Agreement for any of the following reasons:
• Failure to show up for scheduled client appointments.
• Failure to pay rent on time.
• Consistently paying rent late.
• Accumulation of debt with the shop.
• Publicly damaging the shop’s property or reputation.
• Causing discord or conflict between coworkers, contractors, or staff.
• Being visibly intoxicated at work.
8. Insurance Requirement
8.1 The Tenant agrees to maintain liability insurance covering the operation of their business at Inkestry Custom Tattoos. The Landlord must be named as an additional insured on the policy. Proof of insurance must be provided upon signing this Agreement and upon renewal of the policy.
9. Modification of Agreement
9.1 This Agreement cannot be modified during the annual term. The Tenant may choose to revise, renew or cancel the Agreement at the end of each annual term.
10. Governing Law
10.1 This Agreement shall be governed by and construed in accordance with the laws of the State of California.
